This document sets
forth the privacy policy (the “Privacy Policy”) of the AvaKIT Website (
www.avakit.com
). This Privacy Policy forms part of
the Terms of Use.
The Website and
Service (collectively, the “Avakit Offerings”) are not intended for use by
anyone not able to enter into legally binding contracts. If you are not able to
legally form binding contracts, you may not use the Avakit Offerings or submit
information about yourself. Without limiting the foregoing, the Avakit
offerings are not intended for and may not be used by children under the age of
13, nor may they be used to solicit or collect any information from children
under the age of 13. If you have objections to this Privacy Policy, you should
not, access, sign up for or use, as applicable, the Avakit Offerings.
Any capitalized terms
used and not defined in the Privacy Policy are defined in the Terms of Use.
Avakit’s Privacy
Principles
Avakit was created to help you to
make your updated contact details available
to friends and people around you.
Your
Information is your own and you decide who will have access to it:

You can make different elements of your contact information (e.g.
phone, personal email, work email, etc) available to different sets of people,
depending on the information they already know about you, whether it is their
knowledge of your current or past contact information elements

You can control the contact information elements that you want
to share, and the conditions limiting the sets of people who can access them,
by defining your settings in the control room page
·
You may add, delete, or modify your contact information elements
and settings in the control room at any time
Your
Information
When you sign up for an Avakit account, you may provide us with “Your
Account Information”, and “Your Personal Contact Information Elements” — each
described in detail below (collectively, “Your Information”).
Your Account
Information:
When you register with Avakit, you
provide us with certain personal information, such as
your name, your email address, a security question and answer. Avakit will also
ask you to provide a private password.
All of such information will become part of Your Account Information.
This information is stored on Avakit’s secure servers. All information included
within Your Account Information will not be shared with any outside parties. If you forget your password, your password
can be reset by following the Forgot Password link in which a confirmation
e-mail will be sent to the registered e-mail address you specify, after you
give the correct answer to your security question. The e-mail will contain a
new arbitrary password which you can later change at your convenience. You are
responsible for maintaining the secrecy of your password and, since it allows
access to Your Account Information, we recommend that you do not divulge your
password to anyone.
Your Personal Contact
Information Elements:
When you join Avakit, you can store
contact information about yourself (e.g. your current or past phone number, email,
Skype ID, etc). You may then choose who will have access to this information by
creating relationships between information that people are required to already
know, and the new elements of your contact information that they will gain
access to. You store your contact information elements and define the
relationships described above in the control room. Note that users are
not required to be registered with Avakit to try to look-up your contact
information in the Avakit home page. However, only those users who provide the correct required information as
defined in your control room, will have access in their search results to
only the corresponding elements of your contact information, as defined in your
control room. All sharing of Your Personal Contact Information Elements
information, as you define in the control room, is done at your own
risk.
Additionally, we may use Your Information:
For assessment of service levels;
To provide you with information about Avakit, services, news and events
through e-mail;
To provide you with personalized notices, instructions
and support.
Any improper collection or misuse of information provided on Avakit is a
violation of the Avakit Terms of Service and should be reported to
legal@avakit.com.
Limited Data Sharing
with Third Parties
Avakit is committed to protecting your privacy. We may share aggregated
and anonymous demographic information; for example, we may share such information
as the total number of users of Avakit or the broad geographic frequency of
use. We may also develop algorithms leveraging the information in the Avakit
database for such purposes as network analysis, or spam and fraud prevention. However,
no such information will be linked directly to Your Information or other
personally identifiable information.
Although we will use every reasonable effort to preserve your privacy, we
may need to disclose Your Information, including personally identifiable
information, only in limited circumstances where we believe such sharing is 1)
reasonably necessary to offer the service, 2) legally required. For example:

We may disclose Your Information to
service providers to help us bring you the services we offer. Specifically, we
may use third parties to facilitate our business, such as to host the service
at a co-location facility for servers, to remove repetitive information from
our user lists, to provide other network administration tasks. In connection
with these offerings, our service providers may have access to Your Information
for use for a limited time in connection with these activities. Where we
utilize third parties who may access your personal information, we implement
reasonable contractual and technical protections limiting the use of that
information to the Avakit-specified purposes

We may need to disclose Your
Information when required by law if we have a good-faith belief that such
action is necessary to comply with a current judicial proceeding, a court order
or legal process served on Avakit. Additionally, we may share information when
we believe it is necessary to prevent fraud or other illegal activity
perpetrated through the Avakit service. We will notify you of such actions
where reasonable and permitted by law

If the ownership of all or
substantially all of the Avakit business were to change, Your Information may
be transferred to the new owner so the service can continue operations. In any
such transfer of information, Your Information would remain subject to the
promises made in any pre-existing Privacy Policy (see “Change of Ownership or
Other Business Transition” section for more information)
Rights to Your
Information
You have the right to access, correct, update, and/or delete Your
Personal Contact Information Elements at any time. You can do so by logging
into the Avakit Website and using the control room page. Changes to Your
Personal Contact Information Elements are typically executed immediately. For
example, if you delete a contact information element from your control room
and successfully save the changes using the “Save changes” button, then that
contact information element immediately becomes inaccessible to anyone who
tries to look-up your contact information using the Avakit home page. Note
that such deleted information is completely removed from the active Avakit
servers although removed information may persist in backup copies for a
reasonable period of time.
Change of Ownership
or Other Business Transition
In the event Avakit goes through a business transition, such as a merger,
acquisition or the sale of all or substantially all of its assets (a “Business
Transition”), the Avakit databases containing Your Information will, in most
instances, be part of the assets transferred. In such
event, you will be notified via e-mail and/or through a notice on our Web site
and any other appropriate methods prior to the Business Transition, and
Avakit’s custody of Your Information will be transferred subject to all the
terms and restrictions in this Privacy Policy.
Following a Business Transition, Avakit or its successors (“We”) may
continue to use Your Information provided such use is in accordance with the
Privacy Policy in effect prior to the Business Transition. If, however, We plan to use Your Information in a manner different from
that stated in the pre-existing Privacy Policy, We will notify you via e-mail
and/or through a notice on our Web site and any other appropriate methods. You
will have a choice as to whether or not We use Your
Information in this different manner.
Links
Avakit may contain links to other websites. We are of course not
responsible for the privacy practices of other web sites. We encourage our
users to be aware when they leave our site to read the privacy statements of
each and every web site that collects personally identifiable information. This
Privacy Policy applies solely to information collected by Avakit.
Children’s Privacy
Avakit is committed to protecting the privacy of children and we
encourage parents and guardians to take an active role in their children’s
online activities and interests. Avakit’s offerings are not intended for and
may not be used by children under the age of 13. Avakit does not knowingly
collect information from children under the age of 13 and Avakit does not
target its Offerings to children under 13. If you believe that we might have
any information from or about a child under 13, please
contact us at legal@avakit.com.
We recommend that minors over the age of 13 (i.e. between the ages of 13
and 18) ask their parents for permission before sending any information about
themselves to anyone over the Internet.
Security
Avakit takes appropriate precautions to protect our users' information.
Your Information is located on a secured server behind a firewall. When you enter sensitive information (such as your password), that
information is encrypted. Because email and instant messaging are not
recognized as secure communications, we request that you not send private
information to us by email or instant messaging services. If you have any

Changes to the Avakit
Privacy Policy
We reserve the right to change our Privacy Policy at any time.
Non-material changes and clarifications will take effect immediately, and
material changes will take effect within 30 days of their posting on this site.
If we make material changes to this policy, we will notify you here, by email,
or through notice on the Website.
